By downloading, installing, or using the NowPresent application ("App") or visiting nowpresent.app ("Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the App or Site.

NowPresent is a digital wellness application for iOS that uses on-device behavioral analysis and AI to detect unhealthy phone usage patterns and suggest positive micro-interventions. The App operates entirely on your device with no server-side processing of personal data.

NowPresent is a wellness tool, not a medical device. It is not intended to diagnose, treat, cure, or prevent any medical or psychiatric condition.

You must be at least 17 years old to use NowPresent, in accordance with App Store age ratings. By using the App, you represent that you meet this age requirement. The App is intended for personal, non-commercial use only.

Subject to these Terms, NowPresent grants you a limited, non-exclusive, non-transferable, revocable license to use the App on iOS devices you own or control, solely for your personal wellness purposes.

NowPresent may request access to iOS Screen Time (via Apple's DeviceActivityFramework), notifications, and HealthKit data. These permissions are entirely optional and can be revoked at any time through iOS Settings. Granting or revoking permissions will affect certain features but will not prevent basic app functionality.

Use of Apple's Screen Time API requires compliance with Apple's Family Controls entitlement requirements. NowPresent uses this API only for the purpose of detecting usage patterns and delivering wellness interventions, as described in our Privacy Policy.

NowPresent is designed to support healthy phone usage habits. It is not a substitute for professional mental health treatment, medical advice, or psychiatric care.

The App, including its design, code, AI models, intervention content, and all associated intellectual property, is owned by NowPresent and protected by applicable copyright, trademark, and other laws. These Terms do not grant you any rights to use NowPresent trademarks, logos, or branding.

Journal entries, mood logs, and other content you create within the App ("User Content") are stored exclusively on your device. Because we have no access to User Content, we cannot recover it if lost. You are solely responsible for maintaining backups of any User Content you wish to preserve.

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may release updates that change functionality, require newer iOS versions, or alter these Terms. Continued use of the App after updates constitutes acceptance of any changes.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy or completeness of any AI-generated suggestions or behavioral analyses.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOWPRESENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim, or $10 USD, whichever is greater.

These Terms are governed by the laws of the jurisdiction in which NowPresent is registered, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration rather than in court, except where prohibited by law.

We may update these Terms from time to time. We will notify you of material changes through an in-app notice and by updating the effective date above. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
